Criminal Penalties of OWI
In Iowa, a first offense OWI is considered a serious misdemeanor. You may face up to one year in jail and no less than 48 hours in jail. You may also be fined up to $1500, court costs, and a $10 DARE surcharge. You may also be required to undergo a substance abuse evaluation, take a drinking driver's course, and pay any required restitution.
If you are convicted of a second offense, an aggravated misdemeanor in Iowa, you may face imprisonment for up to two years but not less than seven days in jail. You may also face up to $5000 in fines as well as a substance abuse evaluation and a requirement that you attend a drinking driver's course.
A third offense is a class D felony in Iowa. You may face up to five years in jail, fines up to $7500, a substance abuse evaluation, a drinking driver's course, and any applicable restitution. Courts may also take away your driving privileges for up to six years.
